Time Limitation to Bring Wrongful Death or Accidental Death Claim in Connecticut CT

All civil law suits are subject to a Statute of Limitations, which means that you only have a certain amount of time in which to bring a wrongful death action in court. Under Connecticut law, you must bring a wrongful death claim within two (2) years from the date of loss or date of death. Therefore, it is important that you don’t wait to talk to a wrongful death attorney and find out what your rights are for your loved one.

Probate Process to File Wrongful Death Action

A wrongful death suit must be brought under the state’s wrongful death statute. Under Conn. General Statute 52-555, a wrongful death claim must be brought by the representative of the decedent’s estate. This means that before you can even file suit, you need to file an application to open an estate in Probate Court in the town or city where your loved one resided. This is typically done by a spouse, parent, or other family members.

Once an estate is properly opened, C.G.S.§ 52-555 allows for compensation or damages for the loss of life, loss of future wages, pain and suffering, loss of enjoyment of all of life’s pleasures missed, loss of company and consortium, and all medical and treatment expenses, and even funeral costs.

Our firm will handle the probate process for you and your family to allow you to file a lawsuit for all damages you and your family are entitled to for the loss of your loved one.
